Liability

Carriers’ liability for an air freight Shipment (including road transport assistance and en route stops) is limited by the Montreal (Warsaw) Convention, or, if it is non-applicable, by whichever is of lesser value: (i) current market value or declared value; (ii) 19 SDR (Special Drawing Rights) per kilogram (approximately 26 USD per kg). Such limits also apply to other modes of transport, except in the cases when Shipments are transported by road and the following limitations apply.

In cases of cross-border Shipments, liability is limited or deemed to be limited by the Contract for the International Carriage of Goods by Road (CMR), to whichever is of lesser value: (i) current market value or declared value; (ii) 8,33 SDR (Special Drawing Rights) per kilogram (approximately 14 USD per kg). Such limits also apply to transportation via national roads, provided that the applicable national laws on transportation do not impose mandatory or lower liability limits.

If the Sender considers such liability insufficient, he must submit a special declaration of value and request additional insurance or insure the Shipment himself.

Liability is strictly limited to direct losses or damages to the Shipment, when the applicable limited liability per kilogram does not apply to other types of loss or damage (including, but not limited to, lost profits, income, interest, future business), whether or not such losses or damages are special or indirect, and even if the risk of such losses or damages has been addressed.
